1. Who you are contracting with

TickTock Club is provided by From Joy To You, Inc. (“we”, “us”). By using TickTock Club you are entering into an agreement with From Joy To You, Inc. Accounts are created and managed by an adult (“grown-up”) who confirms they are of legal age and, where applicable, has authority to bind the organisation they represent.

2. Acceptance

By creating an account or continuing to use the service you agree to these terms. If you do not agree, please stop using the service.

3. Your account

You must provide accurate information and keep it up to date, and you are responsible for keeping your login details confidential and for activity under your account. Children should use the app with a grown-up’s permission.

4. Acceptable use

You must not misuse the service. In particular you must not:

• use it for anything unlawful, fraudulent or abusive, including spam;
• infringe anyone’s intellectual property rights;
• interfere with security — for example uploading malware, probing our systems, scraping or circumventing technical limits;
• reverse engineer, resell or redistribute the service.

5. Our intellectual property

We own the service and everything in it, including the software, artwork, audio, lesson content and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for personal family use within the plan you have chosen.

6. Service level

We work hard to keep TickTock Club available, but we cannot guarantee that it will be uninterrupted or error free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payments and subscriptions

The family plan is billed monthly and begins with a 7-day free trial. It renews automatically until cancelled, and you can cancel at any time from your account page; you keep access until the end of the period you have paid for.

Payment, billing, tax, cancellation and refund mechanics are handled by Paddle. Please see the Paddle Buyer Terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends you may ask us to export your account data within 30 days, after which it may be deleted.

9. Liability

Our aggregate liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury where that exclusion is not permitted by law. You agree to indemnify us for claims arising from your unlawful use of the service or breach of these terms.

10. General

You may not assign these terms without our consent; we may assign them as part of a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the jurisdiction in which From Joy To You, Inc. is established, and disputes will be heard by the courts of that jurisdiction. We may update these terms and will post the new version here.
